OVERVIEW OF CENTRAL REPOSITORY FOR USERS

Welcome to the Central Repository, a software component repository where developers can make their projects' binaries and source bundles available for download by users.

Central is provided by Sonatype to the public as a community service. There is no charge to use Central, and Sonatype pays all the costs for hosting and bandwidth. The components made available for download via Central are licensed to you by the developers who publish those components and are subject to the terms and conditions of the applicable licenses accompanying such components.

You may access Central services to locate and consume the components it contains provided you do not abuse the service and remain in compliance with our Central Terms of Service. Unfortunately a few bad actors can ruin the experience for everyone. In order to keep this resource performing at acceptable levels for the community, we are forced to monitor for abuse and take appropriate actions to stop and prevent further abuse.

In short, if you're doing something that you think we may not approve of, it's probably going to be flagged as abuse, so don't do it. If you're not sure, ask us at http://www.sonatype.com/contact/general-inquiry. The fact that you take the time to ask first sets you apart from the abusers who expect unlimited free bandwidth. Direct communication will generally enable us to help you accomplish your goals without negatively affecting the community's resource.

While we try to encourage contribution of components from trusted sources, ultimately we are unable to ensure that every component is fit for its stated purpose and is free from serious flaws, either intentional or accidental. The user bears all risk resulting from downloading and/or executing any of the components contained by Central.

This has just been an overview of some key points relating to use of Central. The actual Central Repository Terms of Service that govern your use of Central are set forth below. CENTRAL REPOSITORY TERMS OF SERVICE

  1. Acceptance of Terms:

    Welcome! Sonatype, Inc. ("Sonatype" or "us" or "we") welcomes you to the Central Repository and other similar services provided by Sonatype at Sonatype.org and related sub-domains (collectively, "Central"). Central is a software component repository hosted by Sonatype, where developers may post code to their projects for download by users. These Central Repository Terms of Service ("Terms of Service") govern your use of Central.

    By using or accessing any part of Central, you are agreeing to these Terms of Service and our Privacy Policy. If you are a U.S. government user or otherwise accessing or using Central in a government capacity, the U.S. Government Amendment to Central Terms of Service applies to you, and you agree to its provisions.

    If you do not agree to these Terms of Service, you may not use Central. We may change these Terms of Service at any time without any notice to you. It is your responsibility to review these Terms of Service from time to time for any changes, as it creates binding legal agreement between you and Sonatype. If you use Central after we've changed any of the Terms of Service, you are agreeing to all of the changes. Again, if you do not agree, don't use Central.

  2. Permission to Use Central

    We are making Central available to you to download open source software code, proprietary software code and related materials. You have our permission to use Central, but only if you follow all the rules and restrictions we've spelled out in these Terms of Service.

  3. Use Restrictions

    You may access Central to locate and consume the components it contains, provided you do not abuse the service. Sonatype reserves the right to determine when abuse is occurring and what acceptable actions are to stop it or limit its impact on the service.

  4. Materials

    1. Definition. "Materials" means source code, code samples, object code, encryption keys, technical materials, documentation, discussion thread postings, weblogs, wikis, data and any other content, information or technology available via Central.

    2. Applicable Licenses. Third party Materials available on Central may be accompanied by their own licenses or terms of use. The applicable licenses or terms of use which accompany any Materials you download will govern your rights and obligations regarding such Materials, and you agree to be bound accordingly. With respect to any other matters, including but not limited to your use of Central and obligations to Sonatype, these Terms of Service control.

    3. User Bears Risk. You understand that Sonatype does not pre-screen Materials, and you agree to assume all risks in using them. These risks include, but are not limited to, errors, viruses, worms, time-limited software that expires without notice, and the possibility that the Materials infringe or misappropriate the intellectual property rights of others. You agree to assume all such risks.

    4. No Responsibility for Third Party Opinions. You understand that the Materials may contain the opinions of others and you do not hold Sonatype responsible for such opinions.

    5. Copyright Infringement. If you believe that something on Central violates your copyright, notify our copyright agent in writing. The contact information for our copyright agent is at the bottom of this section.

      In order for us to take action, you must do the following in your notice:

      1. provide your physical, email or electronic signature;
      2. identify the copyrighted work that you believe is being infringed;
      3. identify the item on Central that you think is infringing your work and include sufficient information about where the material is located on Central so that we can find it;
      4. provide us with a way to contact you, such as your address, telephone number, or e-mail;
      5. provide a statement that you believe in good faith that the item you have identified as infringing is not authorized by the copyright owner, its agent, or the law to be used on Central; and
      6. provide a statement that the information you provide in your notice is accurate, and that (under penalty of perjury), you are authorized to act on behalf of the copyright owner whose work is being infringed.

      Again, we cannot take action unless you give us all the required information.

    6. Repeat Infringement. It is Sonatype's policy, in appropriate circumstances, to disable and/or terminate the accounts of Central users who repeatedly infringe or are repeatedly charged with infringing the copyrights, trademark rights, other intellectual property rights or publicity rights of others.

    7. Management of Materials and Access. You agree that Sonatype has sole discretion in deciding whether to accept and post Materials, and that Sonatype may delete Materials for any reason (including no reason) whatsoever. You understand that access to Central may be limited for technical reasons, that outages may occur, and that Sonatype has no obligation to store or back up any Materials. You agree that Sonatype has the right to restrict or terminate, in its sole discretion, access to Central for any reason, including its belief that a user has violated these Terms of Service.

    8. Links to Other Sites. Central may contain links to other websites that we don't own or control. We are not responsible for any of these other websites. You will not hold us responsible for any aspect of these other websites, including their content, privacy policies, or anything else. You may be exposed to things on other websites that you don't like or that you find offensive. We are not responsible for this, either. You must use your own discretion when you go to other websites. You should also read the terms and conditions and privacy policies of these other websites.

  5. Privacy

    You consent to the collection, processing and storage by Sonatype of any personal information provided by you in accordance with the terms of Sonatype's Privacy Policy, which is available at http://www.sonatype.com/usage/privacy-policy. You agree to comply with all applicable laws and regulations and the terms of Sonatype's Privacy Policy, with respect to any use by you of any personal information in connection with Central.

  6. How to Communicate with Us

    Only notices about copyright infringement should go to our copyright enforcement department. If you have anything else to communicate with us (like feedback, comments, requests for technical support), you should contact us through our contact page at http://www.sonatype.com/contact/general-inquiry.

  7. Submissions to Central

    If you are interested in submitting code to Central, please visit http://central.sonatype.org/publish/publish-guide/ for the submission process and related terms. If you do submit any code to Central, you grant us the right to make that code available to users of Central for their use under the terms of the license you designate for the submission.

  8. Warranty Disclaimer

    USE OF CENTRAL IS AT YOUR OWN RISK. CENTRAL AND ALL MATERIALS FOUND ON IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SONATYPE AND ITS AFFILIATES, SUPPLIERS AND PARTNERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

    SONATYPE AND ITS AFFILIATES, SUPPLIERS AND PARTNERS MAKE NO WARRANTY THAT (I) CENTRAL OR ANY MATERIALS FOUND ON IT WILL MEET YOUR REQUIREMENTS; (II) CENTRAL WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; OR (III) THAT THERE WILL BE NO ERRORS IN CENTRAL OR THAT SONATYPE WILL FIX ANY ERRORS. ANY MATERIALS OBTAINED THROUGH USE OF CENTRAL ARE OBTAINED AT YOUR OWN DISCRETION AND RISK AND SONATYPE SHALL NOT BE RESPONSIBLE FOR ANY DAMAGE CAUSED TO YOUR COMPUTER OR DATA OR FOR ANY BUGS, VIRUSES, TROJAN HORSES OR OTHER DESTRUCTIVE CODE RESULTING FROM USE OF CENTRAL OR ANY MATERIALS OBTAINED FROM CENTRAL.

    SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER LEGAL RIGHTS, WHICH VARY FROM STATE TO STATE.

  9. Limitation of Liability

    TO THE FULLEST EXTENT PERMITTED UNDER LAW, SONATYPE AND ITS AFFILIATES, SUPPLIERS AND PARTNERS HAVE NO OBLIGATION OR LIABILITY (WHETHER ARISING IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR LIABILITIES (INCLUDING, BUT NOT LIMITED TO, ANY LOSS OF DATA, REVENUE OR PROFIT) ARISING FROM OR RELATED TO YOUR USE OF CENTRAL OR ANY MATERIALS PROVIDED BY OR THROUGH CENTRAL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE. THE FOREGOING LIMITATION APPLIES TO DAMAGES ARISING FROM (I) YOUR USE OR INABILITY TO USE CENTRAL; (II) UNAUTHORIZED ACCESS TO OR ALTERATION OF MATERIALS; (III) THIRD PARTY MATERIALS MADE AVAILABLE TO YOU THROUGH CENTRAL OR (III) ANY OTHER MATTER RELATING TO CENTRAL. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF INCIDENTAL, CONSEQUENTIAL OR OTHER TYPES OF DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

    NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, SONATYPE'S LIABILITY AND THE LIABILITY OF EACH OF ITS OFFICERS, DIRECTORS, INVESTORS, EMPLOYEES, AGENTS, ADVERTISERS, LICENSORS, SUPPLIERS, SERVICE PROVIDERS AND OTHER CONTRACTORS TO YOU OR ANY THIRD PARTIES UNDER ANY CIRCUMSTANCE IS LIMITED TO A MAXIMUM AMOUNT OF $100.

  10. Indemnity

    You agree to indemnify and hold harmless Sonatype and its affiliates, suppliers, partners, officers, agents, and employees from and against any claim, demand, losses, damages or expenses (including reasonable attorney's fees) arising from your use of Central, your connection to Central, your violation of these Terms of Service or your violation of any rights of any third-party. Your indemnification obligation will survive the termination of these Terms of Service and your use of Central.

  11. Termination and Suspension

    We may terminate or suspend Central or any part of Central, terminate or suspend or your use of Central, block any IP address, or remove any Materials available on Central at any time without cause without any liability to you.

    Further, we may terminate or suspend your permission to use Central immediately and without notice upon any violation of these Terms of Service, your failure to pay any fees when due, upon the request of law enforcement or government agencies, for extended periods of inactivity, for unexpected technical issues or problems or for engagement by you in fraudulent or illegal activities.

  12. Export Control

    You may not use, export or re-export any Materials or any copy or adaptation of such Materials, or any product or service offered on Central, in violation of any applicable laws or regulations, including, without limitation, United States export laws and regulations.

  13. General Terms

    These Terms of Service are governed by laws of the state of Maryland (but expressly excluding the Uniform Computer Information Transactions Act as enacted in Maryland), without respect to its conflict of laws principles. The sole jurisdiction and venue for any claim arising from Central and these Terms of Service shall be the state and federal courts located in Howard County, Maryland and each party hereby consents to the exclusive jurisdiction and venue of such courts. These Terms of Service, together with our Privacy Policy and any other legal notices we have published on Central, constitute the entire agreement between you and us regarding Central. If a court having proper authority decides that any portion of these Terms of Service is invalid, only the part that is invalid will not apply. The rest of these Terms of Service will still be in effect. If we waive any of our rights under these Terms of Service in any particular instance, it does not mean that we are waiving our rights generally or in the future. Furthermore, just because we may not enforce all our rights all of the time, it does not mean that we are waiving our rights. We may decide to enforce them at a later date. These Terms of Service, and any rights and licenses granted under these Terms of Service, may not be transferred or assigned by you, but may be assigned by us without restriction.

    YOU AGREE THAT IF YOU WANT TO SUE US, YOU MUST FILE YOUR LAWSUIT WITHIN ONE YEAR AFTER THE EVENT THAT GAVE RISE TO YOUR LAWSUIT. OTHERWISE, YOUR LAWSUIT WILL BE PERMANENTLY BARRED.
